Who does what
1.1 Chartermont Private Limited is a technology and record-retrieval service. It is not a law firm, does not practise law, and does not give legal opinions.
1.2 The opinion is the advocate's. A Professional Title Opinion is prepared, signed and issued by an Empanelled Advocate, on the advocate's own letterhead, in the advocate's own name, under the Advocates Act, 1961 and the Bar Council of India Rules.
1.3 The advocate-client relationship is between you and the advocate. The advocate decides whether to accept your matter, owes you the professional duties of an advocate, and is professionally responsible and liable for the opinion. We are not a party to that relationship and do not direct or control the advocate's professional judgement.
1.4 Empanelled Advocates are independent professionals. They are not our employees, partners or agents.
What we provide
Our own services, for our own fee:
- retrieving Public Records (RoR, plot map, benchmark values) and, where asked, applying for an EC on IGR Odisha;
- court-record searches;
- the AI Title Report;
- secure handling of your documents and coordination with the advocate (sharing the file, tracking the timeline, delivering the signed opinion to you).
How a matter runs
3.1 You tell us about the land and share the documents.
3.2 We tell you which Empanelled Advocate is available, their enrolment number and the State Bar Council, and the advocate's professional fee as the advocate has set it. You may ask for a different advocate.
3.3 The advocate confirms acceptance and the scope of the opinion in writing to you (an engagement letter or email from the advocate).
3.4 With your consent we share the documents and our Reports for the matter with that advocate only (Privacy Policy section 6.2).
3.5 The advocate gives you the signed opinion, directly or through us.
Fees
4.1 Two fees, shown separately. Every quote, order and invoice shows (a) our service fee for the services in section 2, and (b) the advocate's professional fee, as a separate line in the advocate's name.
4.2 Our fee is for our services only. It is not a share of, or commission on, the advocate's fee, and the advocate pays us nothing for being introduced to you.
4.3 The advocate's fee belongs to the advocate. It is either billed to you directly by the advocate, or collected by us only as a collection agent on the advocate's behalf, held separately and passed to the advocate in full, without deduction.
4.4 Taxes on each fee are shown on the invoice of whoever charges that fee.
Responsibility
5.1 The advocate is responsible for the opinion. Our Empanelment Agreement requires each Empanelled Advocate to hold professional indemnity insurance.
5.2 We are responsible for our own services in section 2, under the Terms of Service, including the limits in its section 13.
5.3 If you have a complaint about the opinion, raise it with the advocate. We will help, and you may also use our Grievance Redressal Policy for anything about our part.
Confidentiality
The advocate keeps your matter confidential as their professional duty requires. We keep it confidential under the Privacy Policy.
Cancellation
You may cancel before the advocate accepts and get back everything you paid. After acceptance, the Refund and Cancellation Policy section 4 applies.
